You may be familiar with sending broker-to-broker referrals, whether it's within your own office, to an agent in another town, or even to an agent in another state. When sending these referrals, it's important to remember that according to license law, you must also obtain the person's written consent before referring them. This requirement is outlined in the official code of Georgia annotated law 43 - 40 - 25 paragraph B 36, under the section of unfair trade practices. It states that it is considered an unfair trade practice to fail to obtain a person's written agreement to refer them to another licensed broker for brokerage or relocation services, and to inform the person being referred whether or not you will receive valuable consideration for the referral. To ensure compliance with the law, both the GAR contracts forms packages and the RE forms contracts packages provide appropriate forms. In the GAR forms, the specific form for broker-to-broker referrals is the CO-10 Referral Agreement Broker to Broker. This form allows you and the other agents or brokers involved to fill in all the necessary terms, such as the person being referred and the terms of the referral. It's important to note that the GAR form also includes a reminder about the need for another form, the GAR CO-11 Referral Authorization. This form serves as written authorization from the person being referred, stating that they authorize you as the referring agent to refer them to another real estate broker for brokerage and/or relocation services. It also acknowledges that you may receive valuable consideration for the referral. The person being referred should sign and date this form.
